Texas’s approach focuses on governance frameworks, ensuring that organisations developing powerful AI systems have adequate oversight structures. Neither law is perfect. Both could be stronger. But what matters is that they signal something remarkable: the era of regulatory tolerance for AI is over.

Across the Atlantic, the European Union’s AI Act continues its implementation, with prohibited practices bans coming into effect in February 2026. This isn’t a single regulation issued quietly to a specific industry. This is a fundamental reshaping of what AI companies can and cannot do. For this to work, companies need to report accurately on what their systems can and cannot do, what their limitations are, and where bias or errors might appear.

Third, responsible AI means acknowledging harms. The training data problem alone should humiliate the industry. Massive amounts of copyrighted material and personal information have been ingested into AI training sets without meaningful consent or compensation. Yes, that’s a complex legal and technical problem to solve. But the solution starts with acknowledgement, not dismissal of concerns as hysteria.

Fourth, responsible AI requires resourcing safety properly. This is where the rubber meets the road for most companies. Building responsible AI systems is more expensive than building irresponsible ones. Hiring safety researchers costs money. Running red teams costs money. Implementing transparency mechanisms costs money. Auditing for bias costs money. And here’s the difficult truth: many companies have been making these calculations, factoring in the costs of responsibility, and deciding it’s cheaper to risk regulatory fines and reputation damage than to pay for safety upfront. The UK’s AI Opportunities Action Plan, announced in 2025, takes a notably different regulatory approach compared to the EU and increasingly, America. Rather than strict prohibitions and mandatory compliance frameworks, the UK is betting on a lighter-touch approach, emphasising industry self-regulation and flexibility. There are legitimate arguments for this approach. Over-regulation can stifle innovation. Prescriptive rules can become obsolete quickly in a fast-moving field. There’s value in letting industry work out problems rather than having government mandate solutions.

But here’s my view: the UK risks being left behind if it doesn’t take responsibility as seriously as its competitors. When California and the EU have tighter restrictions, companies will naturally gravitate toward those frameworks, even if they’re more burdensome. Why? Because operating in a jurisdiction with clear rules is easier than operating in multiple jurisdictions with conflicting requirements, and because customers increasingly care about whether companies meet high standards.

The smart play for the UK isn’t to avoid regulation entirely. It’s to become the global centre for responsible AI by making it clear that British AI companies operate to the highest standards. That’s not a burden on innovation—it’s a competitive advantage. When the rest of the world is wrestling with how to implement responsible AI, the UK could be exporting frameworks, talent, and expertise. That requires taking responsibility seriously now, before we’re forced into it.

What Gets Lost When We Fail at Responsibility

I want to shift the focus for a moment from business and regulation to something more fundamental: what’s actually at stake when we fail at AI responsibility.

AI systems are making decisions about who gets hired, who gets loans, who gets healthcare, who gets criminally prosecuted. These aren’t hypothetical concerns. They’re already happening at scale. And when those systems are biased, opaque, or poorly audited, real people suffer real consequences. Someone gets denied a job because an algorithm learned discriminatory patterns from historical data. Someone gets a higher interest rate on a loan because of the neighbourhood they live in. Someone gets flagged for enhanced surveillance because of their race or religion.

But here’s what often gets lost in these discussions: the damage isn’t just individual. It’s systemic. When AI systems perpetuate or amplify historical discrimination, they don’t just harm individuals—they entrench inequality. They make it harder to build the kind of inclusive, fair society most of us actually want. And crucially, they undermine the possibility of using AI to solve genuinely important problems: disease diagnosis, scientific research, climate change, educational access.

One of the reasons I founded Inside Out Justice was because I understand what happens when systems meant to be neutral actually embody injustice. Prison systems that are ostensibly objective but function to harm the most vulnerable. That same pattern plays out with AI if we’re not careful. The tools are more powerful, but the stakes are just as high. Responsible AI isn’t just about compliance or risk management. It’s about whether we’re going to build AI systems that work for everyone, or AI systems that work primarily for whoever built them and whoever can afford them.

Let me be direct about why I think 2026 is genuinely a turning point, not just another year in the AI hype cycle.

We’ve reached a point where AI systems are too powerful, too widely deployed, and too consequential to operate on the old model. The old model was: invent something, deploy it, apologise if it breaks something important, iterate quickly, and repeat. That worked for many technologies when the stakes were lower. It doesn’t work anymore. The systems being built now can affect millions of people simultaneously. They can be wrong in ways that cascade through social and economic systems. The cost of moving fast and breaking things is now measured in livelihoods, opportunity, and justice.

At the same time, we’re reaching a point where the path dependency is still changeable. We’re not locked into a particular way of building or deploying AI yet. The frameworks we build in 2026 and 2027 will likely shape the industry for decades. If we build them around genuine responsibility, around transparency, around meaningful oversight, then we create an industry that actually works for broad interests. If we don’t, if we let the pattern of opacity and lack of accountability continue, then we’re setting up for a much more painful reckoning later.

2026 won’t solve everything. Regulation isn’t a magic bullet. But it changes the incentive structure. It makes irresponsibility more expensive. It makes responsibility the default expectation rather than the exception. And that matters enormously.

What You Should Be Looking for in AI Companies

If you’re evaluating AI companies—whether as an investor, a potential employee, a customer, or just someone interested in how this technology shapes society—here are the questions that matter.

First, ask about transparency. Can they explain how their systems work? Not in abstract terms, but specifically? Can they tell you what data trained their system? Can they discuss limitations and failure modes? If their answer is “we can’t disclose that, it’s proprietary,” you’ve learned something important about their priorities.

Second, ask about governance. Who’s overseeing AI development and deployment? Are there people inside the organisation whose job is to push back when others propose irresponsible uses? Has the company done external audits, and what did they find? Are there public commitments to responsible practices that they can be held accountable to? Or is it vague statements and internal processes that no one outside the company can evaluate?

Third, ask about diversity. Who’s building these systems? Are there people in the room with different backgrounds, different perspectives, different lived experiences? Homogeneous teams are more likely to build systems that work for people like them and fail for everyone else.

Fourth, ask how they handle problems. Have they discovered issues with their systems? How did they respond? Did they fix them quickly, transparently report them, and learn from them? Or did they minimise, deny, or obscure? How companies handle failure tells you a lot about their real commitment to responsibility versus their marketing claims.

The Uncomfortable Truth About AI Innovation

I need to be honest about something that doesn’t get discussed enough in optimistic technology circles. Responsibility often does slow down innovation. If you’re checking thoroughly for bias, if you’re building transparency mechanisms, if you’re running robust safety testing, you’re taking time that could be spent shipping new features. Regulatory compliance costs money and attention that could go to other projects. None of this is false.

But here’s the counterpoint: innovation that’s built on shaky foundations fails anyway, just later and more expensively. A company that ships fast but with poor oversight ships systems that might fail catastrophically when they encounter real-world complexity. A company that ignores fairness concerns ships systems that get sued or regulated, losing everything. A company that doesn’t invest in transparency discovers that trust is harder to rebuild than to build.

The right way to think about this is that responsible practices enable sustainable innovation. They slow you down now so that you don’t get crushed later. They cost more upfront so that you don’t lose everything in a regulatory backlash. They require more thinking and more diverse perspectives, which actually makes your systems more robust, not less. This isn’t innovation versus responsibility. It’s responsible innovation versus irresponsible innovation that eventually implodes.

Where We Go From Here

2026 is the year the rubber hits the road. It’s the year where all the conversations about AI ethics stop being theoretical and start being practical. Companies can’t hide behind vague statements anymore because regulators are now enforcing specific requirements. Investors can’t claim they didn’t know there were governance risks because it’s now clear that irresponsible AI companies face real consequences. The public can’t be told they’re being paranoid about AI because the governments and regulators they elected are taking these concerns seriously.

For builders and entrepreneurs working on AI, this is actually opportunity disguised as constraint. The companies that invest in responsibility now will find themselves with regulatory certainty, with more sophisticated investors interested in backing them, with the ability to attract better talent, and with products that actually solve real problems for real people. The companies that resist will find themselves fighting regulators, losing talent to more ethical competitors, and dealing with customer suspicion.

For investors, 2026 is when you can finally distinguish between companies with real competitive advantages and companies that are just riding hype. The hype riders will struggle as scrutiny increases. The genuinely responsible builders will thrive because they’ve already solved problems that others are just discovering.

For everyone else—customers, policymakers, people just trying to understand what’s happening—2026 is the year where you can finally start asking hard questions and expecting serious answers. When a company tells you their AI system is powerful and beneficial but refuses to discuss how it works or what safeguards are in place, you now know that’s a red flag, not just paranoia.

The buzzword era is ending. Not because AI isn’t genuinely transformative—it absolutely is. Not because it’s not valuable—the market opportunity is real and enormous. But because transformation at this scale requires responsibility, and markets—eventually—price that in. 2026 is when the market finally starts the pricing-in process in earnest. Companies that understand that, that embrace it, that build it into their DNA from the beginning, will be the ones we talk about in 2030 as the architects of a more responsible AI industry. Everyone else will be explaining to regulators why they didn’t see this coming.
